These Terms of Service ("Terms") govern your access to and use of the Fyndra platform operated by FYNDRA (OPC) PRIVATE LIMITED ("Fyndra", "we", "us"). By creating an account, placing an order, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. What Fyndra is
Fyndra is a hyperlocal marketplace that lets end customers ("Shoppers") place orders from independent local shops ("Shops") for pickup or home delivery. Fyndra is a technology intermediary as defined under the Information Technology Act, 2000. Fyndra does not itself manufacture, produce, or own the products sold on the Platform, and does not employ the shopkeepers listed on the Platform. Each Shop is an independent seller responsible for the products it lists, its pricing, and the fulfilment of its orders.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract under Indian law to use the Platform. By registering, you represent that the information you provide is accurate and complete.
3. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. Notify us at info@fyndra.in if you believe your account has been compromised.
4. Shop obligations
Shops using the Platform agree that they will:
- List only products they are legally entitled to sell in India.
- Provide accurate product descriptions, weights, prices (inclusive of applicable taxes), and stock information.
- Fulfil accepted orders in a reasonable time and communicate substitutions or delays through the Platform.
- Comply with all applicable laws including FSSAI (for food), the Legal Metrology (Packaged Commodities) Rules, and any category-specific licences.
- Not engage in price manipulation, false advertising, or discriminatory practices.
5. Shopper obligations
- Provide a valid delivery address and be reasonably available to receive the order.
- Pay for orders in full via the payment methods offered on the Platform.
- Not use the Platform for any illegal purpose or to defraud any Shop or Fyndra.
6. Payments
Online payments are processed by our payment partner. Fyndra does not store your full card or bank credentials. Where cash on delivery is offered, payment is collected at the point of delivery or pickup. Any subscription or platform fees payable by Shops are set out in the separate merchant agreement between the Shop and Fyndra.
7. Substitutions, cancellations, and refunds
Fresh and specialty items may occasionally be out of stock. When this happens, the Shop may offer a substitution which you can Accept, choose an alternative, or Skip. Cancellations and refunds are governed by our Refund & Return Policy.
8. Prohibited conduct
- Uploading unlawful, obscene, defamatory, or infringing content.
- Attempting to interfere with, disrupt, or reverse-engineer the Platform.
- Using the Platform to send spam or unsolicited communications.
- Impersonating another person or entity.
9. Intellectual property
The Fyndra name, logo, website, and application are the intellectual property of FYNDRA (OPC) PRIVATE LIMITED and its licensors. You may not copy, modify, or distribute any part of the Platform without our written consent. Content uploaded by Shops (including product photos and descriptions) remains the property of the respective Shop.
10. Limitation of liability
To the maximum extent permitted by law, Fyndra shall not be liable for indirect, incidental, special, or consequential damages arising out of your use of the Platform. Fyndra's aggregate liability for any claim arising out of these Terms shall not exceed the value of the disputed order. Fyndra acts as an intermediary and does not warrant the quality, safety, or accuracy of products listed by Shops beyond what is required of intermediaries under Indian law.
11. Indemnity
You agree to indemnify and hold Fyndra, its directors, officers, and employees harmless from any claim or demand arising from your breach of these Terms or your violation of any law or third-party right.
12. Termination
We may suspend or terminate your access to the Platform at any time if we believe you have violated these Terms, engaged in fraud, or if we are required to do so by law. You may close your account at any time by writing to us.
13. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts at Chengalpattu, Tamil Nadu, shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, subject to any statutory consumer forums having concurrent jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Platform. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
